Terms and Conditions

The terms and conditions for using STROOMkast consist of several sections. Please read them carefully. If you have any questions or uncertainties, you are always welcome to contact Buitenkast BV.

1. General

STROOMkast is an activity of Buitenkast BV.

Anyone who makes use of STROOMkast (for any purpose whatsoever) agrees to the terms and conditions set out below.

In addition to these terms, the General Delivery Conditions for Installation Companies ALIB 2024 apply to the activities of Buitenkast BV. These terms take precedence, followed by the ALIB 2024. In the unlikely event of a contradiction between the two documents, these terms shall prevail.

2. Personal Data Policy

The personal data policy, or privacy policy, describes how Buitenkast BV handles collected personal data in accordance with the General Data Protection Regulation (GDPR).

General
1. All data provided to Buitenkast BV or collected via its websites is stored by Buitenkast BV and used exclusively for internal and automated processing, in the context of responsible customer management and business operations.

2. STROOMkast users have the right to access, correct, and delete their own data. If users no longer wish to receive direct communications (by post and/or email), these will be removed from the mailing list immediately upon written request.

Data Processing
3. Only the necessary personal data is processed for the provision of services, such as name, address, and contact details. The STROOMkast user retains full control over this personal data and is responsible for the accuracy of the data they enter or process.

4.Buitenkast BV takes appropriate technical and organisational security measures to protect personal data against loss and/or any form of unlawful processing. In the event of a personal data breach, Buitenkast BV will notify the user in a timely manner with all available information and take appropriate measures to prevent and/or limit further breaches. It is solely the responsibility of the user to report any identified data breach to the Data Protection Authority and/or the affected individuals.

5. The user is responsible for determining retention periods for personal data. Where personal data is under the user’s control, the user shall delete it in a timely manner. Buitenkast BV will delete personal data within thirty days of the termination of the agreement, unless legal obligations require it to be retained longer. If the user requests in writing, the data may be retained for a longer period.

6. Buitenkast BV will, where reasonably possible, assist the user in carrying out a data protection impact assessment (Articles 35 and 36 GDPR).

7. Buitenkast BV will, where reasonably possible, make all relevant information available to the user to enable them to comply with GDPR obligations or other applicable personal data legislation. In addition, Buitenkast BV will cooperate with audits and inspections upon the user’s request. Buitenkast BV is entitled to charge the user for any costs associated with this.

Confidentiality
8. Buitenkast BV will not sell data to third parties and will only share it with selected third parties involved in carrying out assignments and services. Employees of Buitenkast BV and engaged third parties are required to respect the confidentiality of data. All employees of Buitenkast BV and involved third parties are bound by a confidentiality obligation.

Cookies
9. Cookies are small pieces of information stored by the visitor’s browser on their computer. Buitenkast BV uses cookies to recognise a user on subsequent visits. Cookies enable Buitenkast BV to collect information about the use of its services and to improve and tailor them to the preferences of its visitors. Cookies may provide information relating to personal identification. Visitors can configure their browser to prevent cookies from being received while using the STROOMkast website and/or web portal.

Log Files
10. Buitenkast BV uses IP addresses to analyse trends, track users, and gather demographic information.

3. User Terms

User Rights
1. With the exception of energy consumption data generated by STROOMkast, users are not permitted to copy, distribute, or disclose any information in any form, in whole or in part, to third parties.

2. The user will be provided with an access code, which is known only to the user. This code can be changed by the user at any time.

3. The user is responsible for keeping the code confidential. Buitenkast BV advises users to change this code periodically. The user bears all consequences (no consequence is excluded) of failing to change this code periodically and/or in a timely manner, and of any use (no use is excluded) of that code, including use beyond the user’s control.

4. n the event of non-compliance with these terms and/or failure to pay the applicable fees on time, Buitenkast BV reserves the right to temporarily or permanently revoke the user’s ability to use STROOMkast or any of its facilities. The user will be notified of this in writing.

Information
5. Buitenkast BV strives to ensure that all information is accurate and that the site is readily accessible. No rights can be derived from the information provided. The information may contain inaccuracies and/or typographical errors. Buitenkast BV does not guarantee the accuracy, completeness, or currency of the information provided.

Availability

6. Buitenkast BV does not guarantee that STROOMkast will operate without errors or interruption, or that it will be accessible at all times. Any liability for damages (direct or indirect) resulting from access to or use of STROOMkast is expressly disclaimed by Buitenkast BV.

7. In the unlikely event that STROOMkast does not function or does not function properly, Buitenkast BV will make every effort to resolve this as quickly as possible, in pursuit of optimal continuity.

Technical
8. The installations (cabinets) operated by STROOMkast are owned by the respective owner, such as a municipality or association. The owner is responsible for providing a properly functioning and safe installation. Users may only connect equipment and/or systems that comply with all applicable regulations. The user’s equipment and/or systems must be inspected, safe, and free from defects and/or damage.

Electrical Requirements
9. The user’s electrical equipment and/or systems must comply with the statutory requirements NEN1010 in the Netherlands, and AREI in Belgium.

10. The following additional conditions apply to vessels (boats): if an isolating transformer is used, the earth terminal must not be connected to the earth terminal of the supplying socket outlet. The vessel’s equipotential bonding must also not be connected to the protective conductor of the supply.

Intellectual Property Rights
11. All rights (including copyright, trademark rights, and any other intellectual property rights) relating to information presented on the website (including texts, logos, illustrations, and photographs) are owned by Buitenkast BV or have been included with the permission of the respective owner.

Amendments
12. Buitenkast BV reserves the right to modify the information on the STROOMkast website (including but not limited to texts, photographs, illustrations, and links to other sites) at any time without prior notice. The user agrees in advance to be bound by any changes to these terms and conditions.
